1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "user") and Welthon App ("Welthon," "we," "our," or "us") governing your access to and use of our website at welthonapp.fun, our mobile application, and all related services (collectively, the "Service").

By creating an account, accessing, or using the Service in any way, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not use the Service.

We reserve the right to update these Terms at any time. Your continued use of the Service following notification of changes constitutes acceptance of the revised Terms.

2. Description of Service

Welthon is a personal wealth management and financial tracking platform designed to help everyday consumers organize, monitor, and better understand their personal finances and investments. The Service includes features such as:

• Portfolio tracking and aggregation across connected accounts
• Financial goal setting and progress monitoring
• AI-powered portfolio insights and informational recommendations
• Risk analysis and portfolio composition reports
• Automated performance reports and summaries

The Service is an informational and organizational tool. It is not a brokerage, bank, investment advisor, financial planner, or any other type of regulated financial institution. Please see Section 5 (Not Financial Advice) and Section 12 (Investment Risk Disclaimer) for important disclosures.

3. Account Registration & Security

To access most features of the Service, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information to keep it accurate
• Keep your password confidential and not share it with any third party
• Notify us immediately at contact@welthonapp.fun if you suspect unauthorized access to your account
• Accept responsibility for all activity that occurs under your account

You must be at least 18 years of age to create an account. By registering, you represent and warrant that you meet this age requirement. We reserve the right to suspend or terminate accounts that we believe belong to minors.

You may not create more than one personal account without our written permission. Accounts are non-transferable.

4. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service for any illegal purpose or in violation of any applicable law or regulation
• Attempt to gain unauthorized access to any portion of the Service or any related systems or networks
• Interfere with or disrupt the integrity or performance of the Service
• Use automated means (bots, scrapers, crawlers) to access or collect data from the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Upload or transmit viruses, malware, or any other harmful code
• Use the Service to transmit unsolicited commercial communications (spam)
• Attempt to probe, scan, or test the vulnerability of any system or network associated with the Service

We reserve the right to investigate and take appropriate legal action against anyone who violates this section, including reporting such conduct to law enforcement authorities.

5. Not Financial Advice

All content, insights, recommendations, analyses, and information provided through the Service are for informational and educational purposes only. They do not constitute personalized investment advice and should not be relied upon as the basis for any financial or investment decision.

Any "recommendations" or "insights" generated by our AI or algorithms are informational in nature and do not take into account your complete financial situation, tax circumstances, risk tolerance, investment objectives, or other factors that a qualified financial professional would consider.

Welthon expressly disclaims any liability arising from reliance on information provided through the Service for financial decision-making.

6. Subscription & Billing

Welthon offers the following subscription tiers:

• Basic (Free): Access to core features at no cost, as described on our pricing page.
• Pro ($12/month): Expanded features including unlimited goals, AI insights, and priority support.
• Premium ($29/month): Full feature access including personal advisor access and advanced analytics.

Paid subscriptions are billed on a monthly basis on the date you initially subscribe. You authorize us to charge your designated payment method on a recurring basis until you cancel. All prices are in USD and are exclusive of applicable taxes.

We reserve the right to change subscription pricing at any time. We will provide at least 30 days' advance notice of any price changes. Your continued use of a paid subscription after a price change takes effect constitutes acceptance of the new pricing.

7. Free Plan Terms

The Basic (Free) plan is provided at no charge and is subject to the limitations described on our pricing page, which we may update from time to time. We reserve the right to modify, limit, or discontinue free plan features with reasonable notice. Access to the free plan does not guarantee any specific level of service or feature availability.

8. Cancellation Policy

You may cancel your paid subscription at any time through your account settings or by contacting us at contact@welthonapp.fun. Upon cancellation:

• Your subscription will remain active through the end of the current billing period
• You will not be charged for the following billing period
• Your account will revert to the Basic (Free) plan at the end of the paid period
• Your data will be retained according to our data retention policy

9. Refund Policy

We offer a 14-day refund on your first paid month of any subscription tier. If you are not satisfied with your first paid subscription, contact us within 14 days of your initial charge at contact@welthonapp.fun and we will issue a full refund.

After the 14-day introductory period, all subscription charges are non-refundable, including for partial months. We do not provide refunds for renewal charges if you forget to cancel prior to your renewal date. It is your responsibility to cancel before the renewal date if you do not wish to continue.

Refund requests made after the 14-day window will be considered on a case-by-case basis at our sole discretion.

10. Intellectual Property

The Service and all of its content, features, and functionality — including but not limited to software, text, graphics, logos, icons, images, audio clips, and the design, selection, and arrangement thereof — are owned by Welthon App or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any portion of the Service without our prior written consent.

You retain ownership of any content you submit to the Service (such as financial goals or notes). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process that content solely for the purpose of providing and improving the Service.

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy carefully to understand our practices regarding the collection, use, and disclosure of your personal and financial information.

12. Investment Risk Disclaimer

By using the Service, you acknowledge and understand that:

• All investing involves risk, and you may lose some or all of the money you invest
• Past investment performance does not guarantee future results
• Market conditions, economic factors, and individual company performance can all negatively affect the value of your investments
• Diversification does not guarantee a profit or protect against loss in declining markets

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WELTHON DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS
• WARRANTIES REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF ANY CONTENT
• WARRANTIES THAT DEFECTS WILL BE CORRECTED

Financial data displayed in the Service may be delayed or inaccurate. We do not warrant the accuracy of any financial data, portfolio valuations, or market information provided through the Service.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WELTHON AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, or data
• Financial losses arising from investment decisions made in reliance on the Service
• Business interruption
• Loss of goodwill
• Any other intangible losses

IN NO EVENT SHALL WELTHON'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO WELTHON IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. In such jurisdictions, the above limitations may not apply to you.

15. Indemnification

You agree to defend, indemnify, and hold harmless Welthon App and its officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use of the Service in a manner not authorized by these Terms
• Your violation of any third-party rights, including intellectual property or privacy rights
• Any content you submit to the Service
• Your violation of any applicable law or regulation

16. Termination

We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice, including if we reasonably believe you have violated these Terms.

You may terminate your account at any time by contacting us at contact@welthonapp.fun or through your account settings.

Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination shall survive, including but not limited to: Sections 5, 10, 12, 13, 14, 15, and 17.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which Welthon App is incorporated, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights.

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

18. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last updated" date at the top of this page
• Send an email notification to registered users at least 14 days before the changes take effect
• Display a notice within the Service

Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of those Terms. If you do not agree to the revised Terms, you must stop using the Service and cancel any paid subscription before the changes take effect.
